Techsho+ Terms of Service

1. Introduction

Welcome to Techsho+ ("the Service"), operated by Techsho ("Company", "we", "us", or "our"). By accessing or using our SaaS platform at techsho.app (the "Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Service.

These Terms apply to all users, including workspace owners, admins, members, and visitors.

2. Definitions

"Workspace" – a tenant account created within the Service.

"User" – any individual accessing the Service.

"Subscription" – a paid plan (Plus or Pro) or the Free plan.

"Content" – any data, text, files, or information uploaded or processed through the Service.

3. Accounts and Registration

You must provide accurate and complete information when creating an account. You are solely responsible for all activities that occur under your account and for maintaining the security of your credentials (including 2FA where enabled).

You agree to:

Not share your login credentials with unauthorised parties.

Immediately notify us of any security breach or unauthorised use.

4. Subscriptions and Billing

4.1 Plans

We offer:

Free: Limited features, usage caps (e.g., 1 seat, 100 leads).

Plus ($29/month): Enhanced features, higher limits.

Pro ($79/month): Full features, white-label, custom domains, unlimited leads.

All paid plans are billed in advance on a monthly recurring basis. No free trials are offered – billing begins immediately upon subscription start.

4.2 Payment

By subscribing to a paid plan, you authorise us to charge your designated payment method (via PayPal, Stripe, or other gateways) for the recurring subscription fees.

If your payment fails, we may suspend or downgrade your workspace until payment is successfully processed.

5. No Refund Policy

All fees are non-refundable. By subscribing, you acknowledge that:

You will not receive a refund for any partial period of use (e.g., if you cancel mid-month, you will not receive a pro-rata refund).

You will not receive a refund for unused time on your subscription.

You will not receive a refund for any setup, administrative, or usage fees already incurred.

We do not offer refunds or credits for service interruptions, whether planned or unplanned, except as expressly required by applicable law.

6. User Data and Privacy

Your use of the Service is also governed by our Privacy Policy (available on the Site). We do not claim ownership of your Content. However, you grant us a limited license to host, store, and process your Content solely as necessary to provide the Service.

7. Acceptable Use Policy

You agree not to use the Service for any unlawful, fraudulent, or malicious activity, including but not limited to:

Sending spam, unsolicited emails, or mass marketing without consent.

Uploading malicious code, viruses, or harmful files.

Violating any applicable laws or regulations.

Attempting to bypass security, rate limits, or access controls.

We reserve the right to suspend or terminate workspaces that violate this policy without prior notice and without refund.

8. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without any warranties of any kind, express or implied.

To the maximum extent permitted by law, Techsho disclaims all implied warranties, including but not limited to:

Merchantability.

Fitness for a particular purpose.

Non-infringement.

Uninterrupted or error-free operation.

We do not guarantee that the Service will meet your specific requirements or that defects will be corrected.

9. Limitation of Liability

To the maximum extent permitted by law, Techsho and its affiliates, directors, employees, and agents shall not be liable for:

Any indirect, incidental, special, consequential, or punitive damages.

Loss of profits, revenue, data, or business opportunities.

Damages arising from the use or inability to use the Service, even if advised of the possibility of such damages.

Our total aggregate liability to you for any claims arising out of or relating to these Terms or the Service shall not exceed the total amount paid by you to Techsho in the twelve (12) months immediately preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Techsho, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:

Your use of the Service.

Your violation of these Terms.

Your violation of any third-party rights (including intellectual property or privacy rights).

Any Content you upload or process through the Service.

11. Termination

You may cancel your subscription at any time via your workspace dashboard. Cancellation takes effect at the end of the current billing cycle – no refunds will be issued for the remaining period.

We may suspend or terminate your account and access to the Service immediately, without notice or liability, if you breach these Terms or if we believe your use poses a security risk.

Upon termination, we may delete your Content and data after a reasonable period, subject to applicable legal obligations.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Your Country/State], without regard to its conflict of law principles.

13. Modifications to Terms

We reserve the right to update or modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use after the effective date constitutes your acceptance of the revised Terms.
